Medical Marijuana Legality in the US

Cannabinoids are chemical compounds produced by the cannabis plant. The most abundant cannabinoids are CBD (Cannabidiol) and Delta-9 THC (Tetrahydrocannabinol). While THC is notable for its intoxicating effects, it also contains properties that can be used medicinally. 

Although the federal government has classified THC as a Schedule 1 Drug since the passing of the Controlled Substances Act in 1973, states have defied these laws using their juridical autonomy. 

Following research in the medicinal properties of cannabis, states passed legislation permitting MMJ for some qualifying health conditions, such as epilepsy, HIV, and cancer.

As a testament of U.S citizens’ belief in the medicinal properties of cannabis, 38 American states have legalized Medical Marijuana (MMJ).

In states where MMJ has not yet been legalized, there are some loopholes to accessing THC.  Some states like Georgia allow residents to purchase “low-THC” CBD oil, which contains more than 0.3% of the federally-legal amount of THC allowed in hemp-derived products.

Unfortunately for residents of Nebraska and Idaho, there is no legal use of cannabis. In the event the medicinal properties of cannabis grow more popular among a large number of citizens, then maybe MMJ will be legalized.

Where is Recreational Marijuana Legal?

Most states have legalized the use of medical marijuana although recreational marijuana is yet to attain that status. But with an increasing trend towards adult-use legalization, we can expect that many more states will legalize recreational marijuana in the future.

For the time being, less than half of the fifty states have legalized or decriminalized cannabis for recreational use. Those states are Colorado, Washington, Alaska, Oregon, California, Maine, Massachusetts, Nevada, Vermont, Michigan, Illinois, New Jersey, Montana, Arizona, New York, Virginia, New Mexico, and Connecticut.

Now, if you are also curious regarding CBD, fortunately, all fifty states have legalized it. After the enactment of the 2018 Farm Bill, you can transport products derived from hemp contingent on them containing less than 0.3% Delta-9 THC.

Delta-8 THC, a cannabinoid with a similar chemical structure to intoxicating Delta-9 THC, is technically federally-legal under the 2018 Farm Bill.

Despite the fact that its effects are mild compared to the effects of Delta-9, many states have been reluctant to legalize it due to its psychoactivity. Subsequently, some states have banned Delta-8, while others have dragged their feet concerning legalization. Some states such as Florida have legalized only MMJ, but this has allowed people to access THC; people who would have otherwise found it hard to do so.
